Need to Return a product?

To return a product at Mpact Services, you'll need to request a Return Merchandise Authorization (RMA) number. This can be done by contacting our service department at sales@mpactexposure.com, or by telephone. NO returns of any type will be accepted without an RMA.

We'll need the following information to authorize your return:
- Customer name
- Invoice number
- Item serial number(s)
- Nature of the problem

In general, Mpact Exposure accepts returns on merchandise from select manufacturers within 30 days. However, Mpact Exposure reserves the right to authorize product returns beyond 30 days from the invoice date. IF the product is accepted after 30 days, credit will be issued toward one of the following:

 

  • FUTURE PRODUCT PURCHASES

  • A FULL CASH REFUND
  • ORIGINAL SHIPPING CHARGES ARE NOT REFUNDED ON RETURNED ITEMS. Customers are responsible for all shipping charges back to Mpact Exposure on returned items, and Mpact Exposure will pay the shipping charges on the replacement or exchange item(s) going back.

Returns within 30 days from invoice date can be for exchange, replacement refund or credit at Your Mpact Services discretion. Please be aware that specific manufacturers have more restrictive return policies.

LIMITED WARRANTY

Mpact Exposure a subsidiary of parent company MPact Production Services, Inc, A Georgia Corporation, having its principal place of business at 5899 Graywood Circle, Mableton, GA 30126 ("Manufacturer") warrants its TALENT-VU CD ROM products (the "Products") as follows: CD ROM containing video footage and other text information.

1.  Limited Warranty
Manufacturer warrants that the Products sold hereunder will be free from defects in material and workmanship for a period of thirty (30) days from the date of purchase.  If the Products do not conform to this Limited Warranty during the warranty period (as herein above specified), Buyer shall notify Manufacturer in writing of the claimed defects and demonstrate to Manufacturer satisfaction that said defects are covered by this Limited Warranty.  If the defects are properly reported to Manufacturer within the warranty period, and the defects are of such type and nature as to be covered by this warranty, Manufacturer shall, at its own expense, furnish, replacement Products or, at Manufacturer's option, replacement parts for the defective Products.  Shipping and installation of the replacement Products or replacement parts shall be at Buyer's expense.

 2.  Other Limits. THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  Manufacturer does not warrant against damages or defects arising out of improper or abnormal use of handling of the Products; against defects or damages arising from improper installation (where installation is by persons other than Manufacturer), against defects in products or components not manufactured by Manufacturer, or against damages resulting from such non-Manufacturer made products or components.  Manufacturer passes on to Buyer the warranty it received (if any) from the maker thereof of such non-Manufacturer made products or components.  This warranty also does not apply to Products upon which repairs have been effected or attempted by persons other than pursuant to written authorization by Manufacturer.

3.  Exclusive Obligation.
THIS WARRANTY IS EXCLUSIVE.   The sole and exclusive obligation of Manufacturer shall be to repair or replace the defective Products in the manner and for the period provided above.  Manufacturer shall not have any other obligation with respect to the Products or any part thereof, whether based on contract, tort, strict liability or otherwise.  Under no circumstances, whether based on this Limited Warranty or otherwise, shall Manufacturer be liable for incidental, special, or consequential damages.

4.  Other Statements.
Manufacturer's employees or representatives' ORAL OR OTHER WRITTEN STATEMENTS DO NOT CONSTITUTE WARRANTIES, shall not be relied upon by Buyer, and are not a part of the contract for sale or this limited warranty.

5.  Entire Obligation.
This Limited Warranty states the entire obligation of Manufacturer with respect to the Products.  If any part of this Limited Warranty is determined to be void or illegal, the remainder shall remain in full force and effect.

PAYMENT

1. Payment: The time for payment for the Products and Services is as follows:

1.1 The Company shall be paid as follows: The Company shall receive payment for Products or Services prior to Delivery. Once payment has been confirmed by the Company, the Company shall delivery products or services within two to three weeks.

Sporting event recording cost:
Pay $150.00 plus Reimbursable Costs (See Payment Sections 1.2, 1.3) 

1.2 Reimbursable Costs: Client shall reimburse the Company all costs incurred in Connection with the Services rendered. Reimbursable costs include, but are not limited to, travel costs, subcontractors, materials, computer costs, telephone, copies, delivery, etc. that are attributable to a project or Service (the "Reimbursable Costs"). Travel costs are defined as air travel, lodging, meals and incidentals, ground transportation, tools, and all costs associated with travel. All extraordinary travel expenses must receive Client's approval. The Company shall provide to Client substantiation of Reimbursable Costs incurred.

1.3 Invoicing:

(a) Invoices will submitted monthly by the Company for payment by Client for Reimbursable cost only. Payment is due upon receipt and is past due seven (7) business days from receipt of invoice. If Client has any valid reason for disputing any portion of an invoice, Client will so notify the Company within seven (7) calendar days of receipt of invoice by Client, and if no such notification is given, the invoice will be deemed valid. The portion of the Company's invoice which is not in dispute shall be paid in accordance with the procedures set forth herein. (b) A finance charge of 1.5% per month on the unpaid amount of an invoice, or the maximum amount allowed by law, will be charged on past due accounts. Payments by Client will thereafter be applied first to accrued interest and then to the principal unpaid balance.

Any attorney fees, court costs, or other costs incurred in collection of delinquent accounts shall be paid by Client. If payment of invoices is not current, the Company may suspend performing further work.

1.4 Taxes:  All amounts payable pursuant to this Agreement are exclusive of shipping charges & taxes.

Accordingly, there will be added to any such amount payable by Client the monetary sum equal to any and all current and future applicable taxes, however designated, incurred as a result of or otherwise in connection with this Agreement or the Services, including without limitation state and local privilege, excise, sales, services, withholding, and use taxes and any taxes or other amounts in lieu thereof paid or payable by Client (other than taxes based on the Company's net income). If Client does not pay such taxes, the Company may make such payments and Client will reimburse the Company for those payments. Client will hold the Company harmless for any payments made by Client pursuant to this Section 2.4.

TESTIMONIAL CONSENT AND RELEASE

For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, client ("Releaser") hereby consents to any use made or to be made by Mpact Exposure a subsidiary of parent company MPact Production Services, Inc, A Georgia Corporation ("Advertiser"), its advertising agency, licenses, and producers or publishers of its promotional material and its and their successors and assigns, any text or other material, prepared or created by Advertiser or any of such other parties at its own expense, which text or other material depicts, quotes or otherwise is attributed to Releaser with respect to the use or ownership by Releaser or the Releaser's family of any product or service manufactured, sold, provided or otherwise distributed by Advertiser; provided, however, that no such text or other material shall hold up to public ridicule or scandal any of Releaser or Releaser's family.

Releaser also hereby releases Advertiser and such other parties from any obligation to make any payment hereunder or from any other liability incurred in connection with the use of any such text or other material in the manner provided above. If the Releaser is less than eighteen (18) years of age, Parent or Guardian, hereby release and agree to indemnify the licensed parties and their respective successors and assigns, from and against any and all liability arising out of the exercise of the rights granted by the above Testimonial Consent and Release.

EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE OR ANY MATERIALS AND PRODUCTS. IN NO EVENT SHALL Mpact Production Services, Inc. BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER WITH RESPECT TO THE SERVICE, THE MATERIALS AND THE PRODUCTS.
